تعدد الآراء في المذهب الحنفي قائم على أصول «الحقيقة والمجاز أنموذجًا» (تخصص أصول فقه)

بسم الله الذي لا تتم النعم إلا باسمه، والحمد لله الذي بّين الطريق وأنار الظلمات بمبعث نبيه محمد صلى الله عليه وسلم الذي هدى به البشر، فأنزل عليه القرآن تبيانًا لکل شيء وتفصيلا.
أما بعد...
إن الإسلام هو خاتم الرسالات وقد جاء مستوفيًا لکل حاجات البشر، ولکي يستطيع المسلم السير على النهج الرباني لابد له من فهم صحيح للمسار الذي رسمه لنا الله عز وجل، وهذا الفهم لا يمکن التوصل إليه إلا بعد بذل الجهد والوقت في الدرس وطلب العلم.
إن علماء هذه الأمة لم يدخروا جهدًا في طلب العلم ولم يتهاونوا في بذل الوقت للوصول إلى الطريق القويم الذي يجب أن ينتهجه المسلم، ولکي يحافظوا على نتاج جهدهم وضعوا قواعد ثابتة سميت ب(القواعد الأصولية)؛ وهي القواعد التي يتبعها الفقيه للوصول إلى الحکم الشرعي.
ولکن البعض في وقتنا هذا يعتقد أن الحکم الشرعي يأتي من فراغ أو أن الفقيه يأخذ بظاهر الأقوال، وهذا قصور حقيقي في فهم کيفية استخراج الحکم، کما إن هذا الفهم الخاطئ فتح المجال لمن يريد أن يستهين بعلماء الأمة أو يريد أن يقلل من الجهد الذي بذلوه بأن يطعن فيهم، ومما يدعو إلى الأسف أن أکثر هؤلاء هم من أبناء هذا الجيل الذين يستمعون إلى هذه الأقوال ويصدقونها بشکل أعمى دون الرجوع إلى الحقائق.
وهذا الأمر هو ما حدانا إلى الکتابة في هذا الموضوع، فکل مذهب بني على قواعد ثابتة وکل إمام انتهج ما رآه هو الأقرب لرضى الله والأصوب للعباد، وهؤلاء الأئمة لم يبنوا آراءهم على هوى أنفسهم بل انتهجوا طريق البحث والاستقراء وتتبع الدليل وتحليل المسائل للوصول إلى الحکم الشرعي، وهذا هو ما قد يؤدي إلى الخلاف في بعض قواعدهم، وإن کانوا من ضمن المذهب الواحد، فالخلاف ليس طعنا في الآخر بل هو الطريق للوصول إلى الحقيقة بما يراه أنسب للعباد.
ولسعة هذا الموضوع، سلطنا الضوء في هذا البحث على أحد القواعد الأصولية في المذهب الحنفي، وقد کان اختيارنا لهذه القاعدة راجعًا إلى أن البعض يعتقد ان اختلاف حکم الإمام عن حکم الصاحبين رحمهما الله هو نقطة ضعف في المذهب يمکن استغلالها للطعن في المذهب وقواعده، ولهذا بينا سبب الخلاف في الأحکام بينهم، وکيف يمکن الثبات على القواعد ولکن بطرق مختلفة، فکل ما يحتاج اليه المرء هو النظر من زاوية مختلفة ليفهم وجهة نظر الآخر.
وقد خرجنا من هذا البحث بعدة نتائج منها:

أن کل المذاهب الإسلامية قامت على أصول وقواعد يجب احترامها وعدم الطعن فيها مهما کان الشخص المتحدث في هذا الوقت، فمن المؤکد أنه لم يبذل عشر ما بذله أولئک في سبيل أقعاد القواعد لمذاهبهم.
أن الاختلاف بين أئمة المذهب الواحد جائز وموجود وهو مبني على اختلاف نظرتهم للأمور، وهذا أمر يحسب لهم لا عليهم فهم ذوو بصيرة نافذة وعقول نيرة.
احترام رأي الآخر فضيلة، فاختلافي مع غيري لا يعني نقصًا في شخصي، ولکنه يعني أن هناک سعة ومجالًا مفتوحًا للجميع، فإن کان هنالک مجال في الأحکام الدينية التي تمس حياة الفرد المسلم للخلاف والتغير حسب الظروف، فمن باب أولى أن يکون هناک سعة في التحاور وتقبل رأي الآخر وعدم تحجير العقول على رأينا فقط.
إن الإسلام دين رحمة، فالأحکام فيها مرونة تتکيف مع حياة المسلم وطرق معيشته.
إن الفکر والنظر للأمور وطرق معالجتها تختلف من شخص لآخر، فهذا الأمر هو طبيعة بشرية خلقها الله عز وجل في بني آدم فيجب فهم هذا الأمر وإعادة بناء شمولية لطرق تفکيرنا.


Abstract:   
The multiplicity of opinions in Hanafi doctrine is based on fundamentals  (Truth and metaphor model).
In the name of Allah, praise be to God, which is revealed and Illuminated the road of darkness by the Prophet Muhammad peace be upon him, which guided humans,  and descended  the Koran to clarify everything and detail.
Islam is the seal of the messages in fulfillment of all human needs. In order for a Muslim to follow the path of the Lord, he must have a proper understanding of the path that God has drawn for us, and this understanding cannot be reached further by exerting effort and time in studying and seeking knowledge.
 The scholars of this nation have spared no effort to seek knowledge and have not wasted time to reach the right path that must be followed by the Muslim. In order to preserve the product of their efforts, they have established rules called "fundamentalist rules", But some people in our time believe that the Islamic ruling comes from a vacuum or that the jurist takes the words, and this is a real failure to understand how to extract the ruling, and this misconception opened the way for those who want to insult the scientists of the nation or wants to reduce the effort they made that And those who claim to regret more than these are the sons of this generation who listen to these words and believe them blindly without reference to the facts.
This is what led us to write in this subject, each doctrine built on fixed rules and all in front of the mirror is the closest to the satisfaction of God and the right to slaves, and these imams did not build their views on their own hue, but followed the path of research and extrapolation and follow the guide and analysis of issues to reach the rule of legitimacy, And this is what may lead to disagreement in some of their rules and if they are within the same doctrine, the difference is not stab in the other, but is the way to get to the truth in what he deems appropriate for the Worshipers.
 In this study, we have shed light on one of the fundamentalist rules of the Hanafi school.    Our choice of this rule is that some believe that the difference between the rule of the imam and the rule of ' alsaahibin' "God have mercy on them"  is a weak point in the doctrine that can be used to challenge the doctrine and its rules. In the judgments between them and how to maintain the rules but in different ways, all one needs to look at from a different angle to understand the other's point of view.
We have emerged from this research with several results, including:

All Islamic doctrines are based on principles and rules that must be respected and not challenged, no matter who is speaking at this time, it is certain that ten of them did not do so in order to make the bases of their doctrines.
The difference between the imam of the one doctrine is permissible and existing, but based on the difference of their view of things and this is calculated for them, they understand people with a clear vision and bright minds..
Respecting the opinion of the other is a virtue. My disagreement with others does not mean a deficiency in my personality, but it means that there is scope and scope for all. If there is scope in the religious rulings that affect the Muslim individual's life of disagreement and change according to circumstances, And accept the opinion of the other and not to stone minds on our opinion only
Islam is a religion of mercy. The rules are flexible and adapt to the life of the Muslim and his ways of living.
 The thought and consideration of things and methods of treatment vary from person to person, this is a human nature created by God Almighty in the sons of Adam must understand this and rebuild the comprehensiveness of our ways of thinking.
