فِكرة عن التحكيم الإلكتروني والمحكمة الفضائية كأحد هيئاتهُ المُتخصصة

كان للتطور الهائل والمُستمر في مَجال تكنولوجيا المَعلومات والاتصالات أثرهُ البالغ في ظُهور التحكيم الإلكتروني وانتشاره في الآونه الآخيرة، حيثُ ظهر التحكيم الإلكتروني كضروره لحَل المُنازعات الناتجة عن التعامُلات الإلكترونية باعتباره وسيلة مُناسبة ومن ذات الطبيعة, وتمتاز بالكثير من المُميزات التي ذُكرت في مَتن البحث، ولإيضاح هذه الفكره تطرقنا إلي تعريف التحكيم التقليدي، والتحكيم الإلكتروني ومفهوم اتفاق التحكيم الإلكتروني، وبيان كيفية عَمل هيئات التحكيم الإلكتروني قُمنا بتناول المحكمة الفضائية بدايةً من أسباب نشأتها مُرورًا بالخدمات غير التحكيمية التي تُقدمها في غير مَجال التحكيم والشُركاء المُتعاونين معها، انتهاءً إلي كيفية عملها ومُباشرتها للدعاوي التي تُنظر في أروقتها بإعتبارها من أهم هيئات التحكيم الإلكتروني المُتخصصة.
Abstract:
 The tremendous and continuous development in the field of information and communication technology has had a great impact on the emergence of electronic arbitration and its spread in recent times, where electronic arbitration appeared as a necessity to resolve disputes resulting from electronic transactions as an appropriate means of the same nature and is characterized by many of the features mentioned in this research, which are mentioned in this research. To define traditional arbitration, electronic arbitration and the concept of the electronic arbitration agreement, and to clarify how the electronic arbitration tribunals operate, we have dealt with the space court starting from the reasons for its inception through the non-arbitration services it provides in the field of arbitration and the partners cooperating with it, ending with how it works and proceeds with the lawsuits that are considered by them. One of the most important specialized electronic arbitration tribunals.
