المعتقدات الدينية وأثرها على تطبيق مبدأ المشروعية في مصر الفرعونية (دراسة تاريخية فلسفية) Religious beliefs and their impact on the application of the principle of legitimacy in Pharaonic Egypt ( A historical and philosophical study)

الملخص

يعد مبدأ المشروعية في الدولة القانونية ضمانة أساسية لحماية الحقوق والحريات في المجتمع وذلك بتحقيق المساواة والعدالة وتحقيق الديمقراطية.

وقد اتجهت كافة الدول في العصر الحديث الي المناداه بتطبيق مبدأ المشروعية كشرط اساسي لكي توصف الدولة بالقانونية.

ومن ثم تكون ذات قبول لدي المجتمع الدولي المعاصر الذي يستنكر الدول البوليسية والاستبدادية، ومن ثم نجد دساتير كافة الدول الحديثة تتضمن احترام وتطبيق مبدأ المشروعية.

وهو ما تضمنته ايضا دساتير جمهورية مصر العربية المتعاقبة.

ولكن اذا كان هذا المبدأ لا خلاف على الاعتراف به من قبل الدول الحديثة فالتساؤل الذي يطرح نفسه هل عرفت الحضارات القديمة هذا المبدأ ومنها الحضارة المصرية الفرعونية ؟





Summary

The principle of legality in the legal state is a basic guarantee for the protection of rights and freedoms in society by achieving equality, justice, and democracy.

All states in the modern era tended to call for the application of the principle of legality as a prerequisite for the state to be described as legal.

Hence, it is acceptable to the contemporary international community, which denounces police and tyrannical states, and then we find the constitutions of all modern states include respect and application of the principle of legality.

This was also included in the successive constitutions of the Arab Republic of Egypt.

But if this principle is not disputed about its recognition by modern countries, then the question that arises is, did the ancient civilizations know this principle, including the Egyptian Pharaonic civilization?
